How to apply for an EHCP

  • Request an EHC Needs Assessment

    To start the EHCP process, you’ll need to formally request an EHC Needs Assessment from your Local Authority (LA). This is typically done by writing a letter or email to the LA’s Special Educational Needs department. Clearly state you are requesting an assessment under the Children and Families Act 2014.

  • Gather Evidence

    Collect documents from educational psychologists, speech & language therapists, occupational therapists, CAMHS, tutors, coaches and other specialists. Use our EHCP Application Checklist and ECHP Evidence Tracker tools to support your application. This evidence will become the main structure of the assessment, showing your needs and the support received or required.

  • Create a Draft Plan

    Explain your goals, current barriers, and what support is currently working best for your child. It is important that Sections B (Special Educational Needs), F (Special Educational Provision), and I (Placement) are specific, detailed, quantified, and accurately reflect your child’s needs and the necessary support so that the local authority can justdge your case accurately. Section F is where you can request tutoring, and more importantly, ADHD, autism, dyslexia, or SEN coaching.

Everything you need to know about EHCP plans

  • What is an Education, Health and Care Plan (EHCP)?

    An EHCP is a legal document for students up to 25 years old that sets out their special educational, health and social-care needs and the provisions required to meet them.

    It replaced the former Statement of SEN in September 2014, extending statutory protection into further-education, apprenticeships and training settings.

    The plan follows an alphabetic structure:

    • A – views, interests and aspirations of the child and parent

    • B – SEN

    • C-D – health and social-care needs

    • E – Long-term outcomes

    • F – precisely-specified special educational provision the local authority must secure

    • G-K – healthcare, social care, placement, personal budget, and advice.

    • Section F includes therapies, assistive technology or specialist tutoring and the local authority is legally required to fund it.

  • How long should the EHCP application take?

    Once a parent, young person or setting requests an EHC needs assessment, the local authority must decide within six weeks whether to assess it and issue written notice at this point.

    If it proceeds, evidence is gathered. It should take no more than 20 weeks from request to the final plan, excluding some limited exceptions.

    If the local authority refuses to assess or issue an EHCP,  parents and young people can enter mediation and, potentially, appeal to the independent SEND Tribunal.

  • What is a personal budget in an EHCP?

    The amount of money identified by the local authority (Section 49, Children and Families Act 2014) that families can manage to fund parts of the provision, often via direct payments.

  • Who can request an EHCP needs assessment?

    Parents, young people (aged 16 and up) or schools can request an EHC needs assessment (under Section 36, Children and Families Act 2014).
